 The Inducks Licence, version 1.0

Everyone is permitted to copy and distribute verbatim copies
of this licence document, but changing it is not allowed.

This Inducks Licence sets forth the terms under which you may copy and
redistribute the data contained in the I.N.D.U.C.K.S. It is based, in spirit and
in wording, on the "GNU General Public Licence Version 2" by the Free
Software Foundation, to whom the Inducks Team is grateful, but it has been tailored
to the fact that we are distributing data rather than executables. It also
takes a slightly different position on the subject of modifications, since
the Inducks Team's aim is to merge all contributions into a global and universally
available database, rather than encouraging fragmentation. The Inducks
Licence was not issued by the FSF nor endorsed by them.

Preamble

The I.N.D.U.C.K.S. (Inducks) is a gigantic cooperative effort to index all the
Disney comics ever published in the world.

This project is successful thanks to the fact that so many dedicated comics
experts have joined forces. Many comics fans had indexed their own
collections, but a global database only became a reality once these various
contributions could be consolidated together under an integrated corpus,
with everything in a compatible format.

All the volunteers who contributed to the Inducks gave their contribution
for free and the result of these efforts is available to everyone for free,
under the conditions set forth below.

The Inducks Licence is intended to ensure that the Inducks stays free and
that it cannot be taken over and made into a proprietary work.

The precise terms and conditions for copying, distribution and
modification follow.

INDUCKS LICENCE
TERMS AND CONDITIONS FOR COPYING, DISTRIBUTION AND MODIFICATION

0. This Licence applies to the I.N.D.U.C.K.S. (hereinafter "Inducks")
and to any work based on it. We shall say "Work" to mean either the
Inducks itself or any derivative work under copyright law: that is
to say, a work containing the Inducks or a portion of it, either
verbatim or with modifications and/or translated into another language.
(Hereinafter, translation is included without limitation in the term
"modification".) Each licensee is addressed as "you".

The Inducks does not contain any graphical components. Graphical
components accompanying any Inducks representation therefore do not
fall under this Inducks Licence.

In what follows, "distribution" is to be intended in the widest sense,
including but not limited to publishing via books, magazines, comics, CDs
and Internet.

1. (VERBATIM REDISTRIBUTION) You may copy and distribute exact byte by
byte copies of the Work as you receive it, in any machine-readable medium,
provided that you also meet all of these conditions:

    a) You must ensure, and make clear to the recipient, that, regardless
of the medium chosen for distribution or publication, the Work is also
available electronically over the Internet to anyone at no charge as a
WWW or anonymous FTP download from a URL you specify.

    b) The copies will by definition contain a copy of this Licence, which
will apply to all recipients of the Work.

You may charge a fee for the physical act of distributing a copy, as long
as you make it clear to the recipient that the fee goes to you and not to
the Inducks Team.

2. You may modify your copy of the Work or any portion of it, thus forming
a new Work, and copy and distribute such Work in any medium (including non
machine-readable formats such as paper publications), provided that you
meet all the conditions of Section 1 plus all the conditions below:

    a) This Licence must apply to all recipients of the Work. The opening
screen, instruction manual, home page or its equivalent must display
    the following paragraph.

"This work, derived from the I.N.D.U.C.K.S., is made available to you under
the terms of the Inducks Licence. A freely downloadable electronic
copy of this work, containing the full text of the Licence, is
available from <insert your URL here>. Full credits about the many
contributors to the original Inducks are available from the "credits"
link of the Inducks home page at <http://members.xoom.com/bolderbast>,
from where the original Inducks itself may also be freely downloaded."

    b) This Licence file must be included intact in the Work.

EXCEPTION: if and only if the distribution method is publication on
paper, then in the paper version you may omit to print this Licence
file (but note that it will still have to be present in the
corresponding electronic version required by 1.a).

    c) The original indexers.legend file, listing names of the
contributors of the original Inducks, must be included intact in
    the Work.

EXCEPTION: if and only if the distribution method is publication on
paper, and your Work only references a subset of the Inducks files,
then in the paper version you may omit to print the entire
indexers.legend file (but note that it will still have to be present
in the corresponding electronic version required by 1.a). You MUST
however print the full names of everyone listed in indexers.legend
as having contributed to any Inducks files that you used in the Work.

    d) The Inducks Team must be allowed (but is not obliged) to convert,
merge and incorporate any of your additions back into the Inducks,
for further redistribution under this licence. If this happens, the
Inducks Team will add you to the indexers.legend for your contribution.

    e) You must cause the modified files (in any format) to carry prominent
notices stating that you changed the files and the date of any change.

These requirements apply to the Work as a whole. If identifiable sections
of that Work are not derived from the Inducks, and can be reasonably
considered independent and separate works in themselves, then this Licence,
and its terms, do not apply to those sections when you distribute them as
separate works. But when you distribute the same sections as part of a
whole which is a Work based on the Inducks, the distribution of the whole
must be on the terms of this Licence, whose permissions for other licensees
extend to the entire whole, and thus to each and every part regardless of
who wrote it.

Thus, it is not the intent of this section to claim rights or contest your
rights to work written entirely by you; rather, the intent is to exercise
the right to control the distribution of derivative or collective Works
based on the Inducks.

In addition, mere aggregation of another work not based on the Inducks
with the Inducks (or with a Work based on the Inducks) on a volume of a
storage or distribution medium does not bring the other work under the
scope of this Licence.

Note that the above conditions do not prevent you from getting paid by a
publisher, nor the publisher from being paid by the buyers of its
publications, if you write an article or book based partly or wholly on
Inducks index data. There is no formal requirement (other than politeness)
to send a copy of such publication to the relevant members of the Inducks
Team. In other words, we will always appreciate it, but there's no obligation.

3. (Section 3 of the GNU GPL deals with the difference between distributing
source or object code; there is no direct equivalent of this in the
Inducks, so we have no such section here. Nonetheless, to simplify
cross-referencing, we provide this null section so as to preserve the same
numbering as the GPL.)

4. You may not copy, modify, sublicence, or distribute the Work except as
expressly provided under this Licence. Any attempt otherwise to copy,
modify, sublicence or distribute the Work is void, and will automatically
terminate your rights under this Licence. However, parties who have
received copies, or rights, from you under this Licence will not have their
licences terminated so long as such parties remain in full compliance.

5. You are not required to accept this Licence, since you have not signed
it. However, nothing else grants you permission to copy, modify or
distribute the Work or its derivative works. These actions are prohibited
by law if you do not accept this Licence. Therefore, by modifying or
distributing the Work, you indicate your acceptance of this Licence to do
so, and all its terms and conditions for copying, distributing or modifying
the Work or any further work in turn based on it.

6. Each time you redistribute the Work, the recipient automatically
receives a licence from the original licensor to copy, distribute or modify
the Work subject to these terms and conditions. You may not impose any
further restrictions on the recipients' exercise of the rights granted
herein. You are not responsible for enforcing compliance by third parties
to this Licence.

7. If, as a consequence of a court judgment or allegation of patent or
copyright infringement or for any other reason (not limited to patent
issues), conditions are imposed on you (whether by court order, agreement
or otherwise) that contradict the conditions of this Licence, they do not
excuse you from the conditions of this Licence. If you cannot distribute
so as to satisfy simultaneously your obligations under this Licence and any
other pertinent obligations, then as a consequence you may not distribute
the Work at all. For example, if a patent or copyright issue would not
permit royalty-free redistribution of the Work by all those who receive
copies directly or indirectly through you, then the only way you could
satisfy both it and this Licence would be to refrain entirely from
distribution of the Work.

If any portion of this section is held invalid or unenforceable under any
particular circumstance, the balance of the section is intended to apply
and the section as a whole is intended to apply in other circumstances.

It is not the purpose of this section to induce you to infringe any patents
or copyrights or other property right claims or to contest validity of any
such claims; this section has the sole purpose of protecting the integrity
of the free distribution system adopted by the Inducks, which is
implemented by public licence practices inspired by those proposed by the
FSF. Many people have made generous contributions of their time, effort
and specialist knowledge to the Inducks in reliance on consistent
application of that system; it is up to the author/donor to decide if he or
she is willing to distribute the fruit of his or her labour through any
other system and a licensee cannot impose that choice.

This section (7) is intended to make thoroughly clear what is believed to
be a consequence of the rest of this Licence.

8. If the distribution and/or use of the Work is restricted in certain
countries either by patents or by copyrighted interfaces, the original
copyright holder who places the Work under this Licence may add an explicit
geographical distribution limitation excluding those countries, so that
distribution is permitted only in or among countries not thus excluded. In
such case, this Licence incorporates the limitation as if written in the
body of this Licence.

9. The Inducks Team may publish revised and/or new versions of the
Inducks Licence from time to time. Such new versions will be similar in
spirit to the present version, but may differ in detail to address new
problems or concerns.

Each version is given a distinguishing version number. If the Work
specifies a version number of this Licence which applies to it and "any
later version", you have the option of following the terms and conditions
either of that version or of any later version published by the Inducks
Team. If the Work does not specify a version number of this Licence,
you may choose any version ever published by the Inducks Team.

When deriving a Work from a given version of the Inducks, any licence that
applies to that version of the Inducks can be chosen as the one that
applies to (and is distributed with) the Work.

10. If you wish to incorporate parts of the Work into other free projects
whose distribution conditions are different, write to the author of the
Work to ask for permission. For a Work which is copyrighted by the
Inducks Team, write to the Inducks Team; we sometimes make exceptions for
this. Our decision will be guided by the two goals of preserving the free
status of all derivatives of our Inducks work and of promoting the sharing
and reuse of information generally.

NO WARRANTY

11. BECAUSE THE WORK IS LICENCED FREE OF CHARGE, THERE IS NO WARRANTY FOR
THE WORK, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN OTHERWISE
STATED IN WRITING THE COPYRIGHT HOLDERS AND/OR OTHER PARTIES PROVIDE THE
WORK "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED,
INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY
AND PERFORMANCE OF THE WORK IS WITH YOU. SHOULD THE WORK PROVE INACCURATE
OR DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR
CORRECTION.

12. IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING
WILL ANY COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MAY MODIFY AND/OR
REDISTRIBUTE THE WORK AS PERMITTED ABOVE, BE LIABLE TO YOU FOR DAMAGES,
INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING
OUT OF THE USE OR INABILITY TO USE THE WORK (INCLUDING BUT NOT LIMITED TO
LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU
OR THIRD PARTIES OR A FAILURE OF THE WORK TO OPERATE WITH ANY OTHER
PROGRAMS), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
